While all the above points make the document illegal, it can still be used to rally people around it, for the sake of national unity and in greater interest of Eritrea.
As long as it’s taken as a minimum program during transition period, I think it’s ok.

Where did you get all this non-sense! Do you know that people like Mahmoud Sherifo (and other members of the G-15) gave their lives for the cause of the document while you were resting – and continue to rest – on your laurels doing nothing?
Nevertheless, no one will find it difficult to see where you are coming from. You are simply doing your job of trying to saw discord/confusion and prevent even a small, first step from being taken toward genuine democratic change in the country. A futile attempt, though!

Brother, do you know what you are talking about ?.
You are objecting to my constitutional right to express my thoughts freely, and yet you claim to stand for democracy and constitutionality. Doesn’t that make you another ‘risi-mirakh’ ?
Any one with a bit of common sense knows that this constitution will never be implemented in its present form, unless you have enough armies to send around the country to silence all those who want see it amended, if not may be partly re-written to include their interests.
Besides, please don’t raise the G15 issue in this context, because the fact that they were jailed calling for its implementation (and I feel sorry for them) is not a legal criteria to impose by their supporters on others.
A constitution, to be accepted by all, it has to be owned first, and to owned it has to agree to. The draft constitution is primarily a political document that has to reflect the aspiration of all stake holders. A constitution imposed by a political elites, can become a cause of much internal conflict and distraction, so you better think before start firing …

I am afraid the sun will set on you waiting for a “perfect” constitution to drop out of the sky while the Eritrean people get decimated by a ruthless, brutal dictatorship.
As for your rights to freely express your opinion, no one has contested them. In fact, I would be solidly behind you if you resolve to act on your ideas and go around the country (with or without an army) and secure the participation, preferences and inputs of those you believe have been left out of the process. Just do not try to discourage others from beginning to tackle our country’s overwhelming problems by taking small, though perhaps imperfect steps.

Wedihager…. I guess you were expecting a complete constitution addressing every aspect of our issues and making every one of us happy. My friend let alone our constitution at its infancy, even countries who had their constitution for hundreds of years they are still going through amendments and changes. We should rally behind our 1997 constitution and make it our launching pad and lets amend the necessary changes as we progress. The other alternative is very dire and a huge mistake. It would be a full support to the tyrant murderer to kill our ratified constitution and granting him permission to draft a new constitution. The drafting process alone would secure his tyranny for another ten years and it would be a sure thing to secure his tyranny for life.
The option is clear weather to rally behind our ratified constitution and eliminate the tyrant and build a democratic and peaceful Eritrea OR allowing the murderer tyrant to draft a new constitution which secures his life time tyranny and killing.

Maybe you can educate me-but If you look at the constitution all the articles are fair and follow democratic ideas. Give me one article that you don’t agree with. I know it cannot be perfect, but like the authors above are suggesting it can be a basis for discussion for all groups who are committed for freedom and democracy in Eritrea. If every opposition group come up with their own articles we will end up divided and will end up victims of the present system.
Also, if you read how the constitution was drafted the representation was fair. Constitution involved 550 members, consisted of the EPLF/PFDJ, members of 6 Regional assemblies and 75 Diaspora representatives.

Sister, yes the [drafting] process was not inclusive. I mean what I said. It doesn’t necessarily mean people were not invited to give their input, even thought such case are also there, but what is more important is whether their wishes were taken into consideration. Behind the scenes, the EPLF did what it wanted to do.

– Well, it’s like when you are asked to sign a contract some of its articles you do not agree to. Obviously you will not do that.
As I said before, the document can serve to rally Eritreans against the tyrant and his brutal regime, but cannot be implemented in it’s present form and content. There are some of our folks who my be thinking, let’s get rid of the tyrant, and then we can see who dares to object to its implementation. In that case of course it will be rejected.

Who drafted the constitution is not an issue. the issue is who ratified the constitution? the constitution was ratified by the EPLF National assembly. The EPLF national assembly do not represent the Eritrean people, therefore the constitution can not be considered as a democratic expression of the Eritrean people. Constitution is a fundamental law of the society, and society need to voluntarily accept the constitution so that they will be governed by it.
Former ELF members participated, former members of ELF say accept the constitution that was ratified by national Assembly of EPLF is not strong argument that could advance the acceptance of the 1997 constitution. because ELF is not Eritrean people, or the participation/acceptance of former ELF members means nothing, it is not that only members of elf did not take part. the constitution was not ratified by the Eritrean people or a truly representative body of Eritrean people.

There was no abnormal condition at the time I believe. It was deliberate attempt on the part of EPLF to impose constitution on the Eritrean people.
The amendment formula put on the constitution can only work under one party system which I believe the intent of the constitution.
The proof is that the law of part formation that was drafted under the leadership of Sherifo.

Treaties and constitutions are paper works that can easily be trampled upon. It is trust that matters. Trust that whoever makes a proposal is genuine, sincere and does not have a hidden agenda.
However, the rush to spawn some type of constitution has exposed our moral insensitivity in a big way. Some past documents have unabashedly proposed the infamous National Service once the regime is removed. Any endeavor to revive the notorious National (Slavery) Service is tantamount to repeating the nightmarish experience of the already traumatized youth. When nations and communities undergo some traumatic experience as a result of some policy, they either revoke it or temporarily shelf it until a better climate. Furthermore, the sudden jump from the culture of letting a violent military organization all the mandate it wants in the past to legalism is a treacherous one.
Is it not a little bit dishonest or deceitful to get into a constitutional frenzy while at the same time frown on or disapprove any discourse about the dark stains in our history? This type of behavior which is still manifested among some of our people will not dissuade the EPLF/PFDJ from continuing to gloat about their nonexistent virtues, what they often incessantly call “tsegatat ghedli”.
Famous and memorable constitutions are only those which without equivocation identify tyranny in all its totality. The additional benefit from it is the less likelihood of relapsing into the same again. In light of this background, thinkers and jurists are thus advised to deliberate on what a friend called “the lived experience”, among the other equally felt pains.

If properly implemented “National Service” is a duty of every citizen like everywhere in the world. The present system should be dismantled, because its Higdef’s slavery and indoctrination. But when young people go through a proper training that gives them skills and experience they need to defend their country in case of need, they will be happy to do it. All those who completed the months of training required by law should go home the next day.

ብመሰረቱ እዚ ህግደፍ ተባሂሉ ዝጽዋዕ ዘሎ ጽማቕ ናይቲ ዝተፋላለይ ወድብ ኣስማት ሒዙ ዝመጸ ብግብረ ዓመጽ ብግሁድን ስዉሩን ብናይ ጽዑቕ ስለያታት መሓውር ዝዓኾኽን፡ ድሕሪ ኣስመራ ምእታዉ ከኣ ዝገበልን ምኻኑ ክንግንዘብ ይግባእ። ብኻልእ ኣዘራርባ ኢስያስ ባዕሉ ኣብ ብዙሕ ኣጋጣሚታት ውድብ ህዝባዊ ግንባር ህዝቢ ኤርትራ ማለት እዩ፡ ነዛ ሃገር እዚኣ ካልእ ዝሓልየላ የልቦን። በጀካይ ካልእ ክመርሕ ዝኽእል ዓቕሚ ዘለዎ የልን ኽብል ደጋጊሙ ኣተንቢሁ እዩ፡ ከምኡ ጌሮም ዘርድእዎ ሳዕብቲውን ኣጥርዩ ሸሚቱ እዩ፡ ቃልስና ምስኦም ክኸውን ኣለዎ።
ስለዚ ነብሱን ውድቡን ልዕሊ ህዝቢ ጌሩ ዘቐመጠ ውልቀ መላኺ እዩ ኣብ ፍትሕን ዲሞክርስን ዝኣምን ሰብ ኣይኮነን። ብቐንዱ ብቲ ብዱዕን ምኩሕን ባህርያቱ ዝግዛእ ባርያ እዩ። ህውከት እምበር ሰላም ዘይፈቱ ስለ ዝአኾነ፡ ዋላ ነቲ ባዕሉ መሪቑ ናቱ ሰባት ኣቐሚጡን መዚዙን ዘንደፎ ሰነድውን ብፍላይ ነታ ናይ ሓደ ፕረርዚደንት “ክልተ ጊዜ” እትብል ሓረግ ምስ ራአየ፡ ምስቲ ዘነበሮ ናይ ዕድመ ምላሽ ናይ ምምራሕ ትጽቢታቱ ስለ ዝጋራጮ፡ ኣይተቐበሎን ጥርሕ ዘይኮነስ፡ ንብዙሓት መሳርሕቶ ዎሆይ ኣያይ እንዳበሉ ኣብ ውዑይን ዝሕልን ዘገልግልዎ ኣሲሩን ቀቲሉን ንሃግርናውን ኣብ ዘይድልን ዘይተጸበዮቶን ኩናት ድቕዲቑ ብዙሕ ገበን ዝፈጸመ ኢደ ወነናዊ ኩቱሩን መላኺ እዩ።
እብምባኣር ከምዝን ካልእ ዘይተጥቕሰን እኩይ ባህርያት ዘለዎ ጋኔን ዝኾነ ስርዓት ኣብ ኣስመራ ኣቐሚጥካ ሕግን ፍትሕን ከነንግስ ኢና ኢልካ ምሕሳብ ንባዕሉ ጌጋ ፈተነ ምኻኑ እዩ።
እንተ እቲ ተነዲፉ ቀሪቡ ዘሎ ቁዋም ኣበይ ተሓቲሙ ብዓል መን ኣርቂቖሞ ብዘይገድስ እቲ ዝእረም ኣሪምካ ኣማሕይሽካ ከም መበገስን መሰጋገርን ዝይንጥቀመሉ ምኽንያት ዘሎ ኣይምስለንን። ኢስያስ ብህይወቱ ከሉ ኣብ ስልጣን ግን ክንዕወተሉ እና ኢልካ ምሕሳብ ኮንቱ ፈተነ ምኻኑ ክንግንዘቦ ዘለና ኣግእዩ።
ብዝያዳ ነታ ለባም ሓብቲ ምሕረት ከም መተሓሳሰቢ ኣብ ርእሲ ልቦምናኻስ እንተዝመኽሩኻ ከም ዘባሃል ብዛዕባ ተቓውምቲ ኩልና ክንግንዘቦ ዘለና ጉዳይ ኣዝዩ ኣገዳሲ ዝብሎ፡ ኩሎም ኣብ ምልጋስ እዚ ስርዓት ይሳማምዑ ምኻኖም ክንግንዘብ ይግባእ፡ እቲ ካልእ ከኣ ከምቲ ናይ ቀደም እሺ ኣያይ እንዳበልካ ዘብዘብ ምባል ከይኸውን ህዝብና እንዳንቃሕና ኩሉ ነገር ኣብ ሰፊሕ ሃገራዊ ባይቶ ኣቢልካ እቲ ዘድለ ህዝባዊ መንግስቲ ክንትክል ዝይካል ኣይኮነን። እዚ ናይ ሃታሃታኣብ ፈቐዶ ስደት ኮንካ ዘይኮንስ ኣብ ትሕቲ ጊዜያዊ መንግስቲ ኮንካ ኣርጠጥካ ኣብ ማእከል ሃገር ኩሉ ብነጻ መድርኽ ኣብ ዝሳተፈሉ ጊዜ ጥርሕ እዩ ክጻፈፍን ክትግበርን ዘካኣል። ናተሃላልዋና ኣብ ግምት ክንእቱ ይግብእ። እቲ በዚ ይኹን በቲ ዝካየድ ጻዕሪ ክንደይ ግዱሳት ደቂ ሃገርና ብገንዘቦም ጊዜኦምን ሰዊኦም ዘካይድዎ ዘለዎ ጻዕሪ ኮንቱ ኣይንግበሮ ሓደራ።
እቲ ዓቢ ጸገምና ከምቲ ብዘመነ ውቤ ዝጸመመስ ዝባን ውቤ ክብል ይነብር ከምዝባሃል ኮይንና ዘሎ ዋላ ነቲ ርእይ ተደጋጋሚ ጥፋትን ጉድለትን እቲ ስርዓት ብዓይኖም እንዳራኣዩን እንድስምዑን፡ ኣህያይ ዘበሎ ድኣ እንዳበሉ ከኒቦም ዘለዉ ኣሓትን ኣሕዋትን ጥርሕ ጉድይ ሃገርናን ህዝብናን ኣዕዚዞም ክግንዘቡን ንድሕነት ሃገሮምን ደው ክብሉን ድጊምስ ወጊድ ውልቀ መላኺ ንኽብሉ ጽዕርና ይዕዘዝ ክብል ምስ ኣኽብሮት ፍቐዱለይ። ኣብ ሓደ ደንበ ከለና ንብላላሕ፡ ንሳሓሀል፡ ዳኣምበር ኣይንመናጨት ሓደራ። ጸላኢናን ፈትውትናን ንምልላይ ብትዕግስትን ምስትውዓል የድልየና ኣሎ። ይቕንየለይ Bዙሓት ለባማት ምስትውዕልትን ኣለኹምና!
