The first one was a joke (lead by people like Bereket) and whatever the worthless Leader in Eritrea is spreading regarding the “now to be written” constitution is also is a worthless.

Why speak now if this man (Bereket) had really some credibility or truth – it was during the first constitution that Bereket should have withdrawn from drafting the first one. I do not know Bereket nor do I have anything against but his own (this is Bereket’s own words) testimony a while back in awate regarding the “muted constitution” process – to paraphrase it in one sentence – {….Issays was manipulating and dictating what to be in it who to be in it….}. Real men and true men who stand for justice would have made an exist rather than writing a “not so complete and questionable draft”. By the way does anyone even know what is in the first draft? I think I vividly remember it was done in a rush rush rush….. (Note: This does not mean I am giving an excuse to the current despotic leaders in Eritrea). They have simply fallen to the newest low after listening to the worthless New Years wish from the would be leader in Asmara.

Back to the constitution: Drafting a constitution is not everything – remember there are a few countries without constitution and have a fair and decent society. What is crucial however is the men and women who would stand for justice, fairness, and truth if and when engaged in something that is monumental and in the face of abuse and injustice.

It is said “There are three classes of men; lovers of wisdom, lovers of honor, and lovers of gain”. Plato – where do we have our sight those who could do something lasting to either our country and/or man kind.

Oaky just my thoughts – save me from your wrath – anyone out there…..
    Peace and Freedom to Eritrea.

      Brother Mike,
As usual well said and I simply find myself agreeing with you in most of your observation
of the good and useless doctor Bereket Habteselassie. I believe we are all evolving in our thinking
and the way we view the world and that I think is a good thing indeed. However, why would any one call
Dr Bereket’s such constitution a “constitution” without popular participation? The good doctor once admitted it himself that a constitution without popular participation isn’t that fair and acceptable.
Eritrea is a multi-ethnic society like all African countries. Can any one explain how representative
democracy reflect equitable political power and equal economic opportunities in a multi-ethnic society?
Does the 1997 constitution guarantee equitable political power and economic opportunities to our
diversities? NO IT DOES NOT. Since the 1997 so called constitution envisioned a “centralized unitary
governance”, how does centralized unitary governance then assure equitable political power in our
diversity? Keep in mind these questions are at the core of our political conflicts while our minorities
are completely scared of “tyranny of majority”.
In short and other words, the constitution should reflect the interest of all social groups otherwise
their ( the minorities) will still continue to secure their interest as well. There should definitely be
a change to that of the good doctor document to simply and importantly accommodate the interest and the
grievances of our minorities in order to avoid mistrust among our diversities.

      • Essayas January 4, 2015

If something better comes in the new to be drafted constitution good luck for you, mourners of life time for being minority. what can Doctor Bereket help to make you the majority in the constitution. in fact my message is directed to the author of the above article it is histeria no one can make sense of your point it is not even clear what you would like to see.

Yodita, the constitution can be amended, and it has to, else we will not be able to get out of the vicious circle we are stuck in.
What type of State are we trying to create ?, this is a fundamental question. In my humble opinion, a reasonable degree of decentralization is necessary. Those who think they can rule from Asmara will be disappointed, because Eritrea has changed a lot, and the time when people used to travel to Asmara to get a paper signed sooner or later will be history.
But not too much decentralization that ends up dividing Eritreans along regional or ethnic lines. To get the right degree of centralization will not be easy, but it’s a truth that we have to face. This is just one of the many issues the amended constitution should solve. Official languages, national flag and State symbols and other important issues also have to be decided upon. On most of these issues Higdef either imposed it’s views or kept them aside to create a time bomb that people cannot handle.
Eritrea is just like any other African country (because there are a few who think we are better). We will make progress if we are open to all and are ready to compromise, otherwise, we will continue to be a failed State that risks to be swallowed by its neighbors.
In a nutshell, the 1977 constitution can be amended BEFORE being implemented to make it acceptable to ALL stakeholders. I think Dr. Bereket is still the right person to head a commission that can revise its amendment.

Mike instead of jumping into name calling and discrediting very credible men with out knowing the facts pls do us and yourself a favor, spend few hours researching the facts and reading the content of our constitution. Mike shame on you for deciding to ignore 99.9% of Dr. Berekets positive contribution for our freedom fight and chose instead to cling to one phrase in an interview and smear our tegadalay,(founding father of our constitution) honorable DR BEREKET HABTESELASSIE. By the way it is the same smear campaign used by the dictator ISAYAS AFEWORKI towards thousands of our gedayim tegadelti before he throw them into the concentration camp. The murderer ISAYAS ignored the 99.9% of sacrifice paid by our heroic tegadelti and picked a word or two (ATALAKIOMNA)from their speech and tried to make them look like traitors and villains. Here is piece of my advise
1-Our constitution was not written in a rush rather it was well researched by highly motivated and educated Eritreans and took around three years.
2-It would be the foundation to build our country and our democracy, and definitely was not written in a stone, so it can be amended.
3-Dont cling to a single lousy story and try to make a conclusion. People and societies are a lot more than a single story, and be cautions and refrain from making judgments based on a single story.(the danger of a single story)
4-We have a cold blooded murderer (ISAYAS AFEWORKI)still experimenting his failed political prostitution on our people and pushing our country to the brink of disaster, so our urgent focus should be on fostering ideas to get us united so we can stop the killing, slavery, torture theft and imprisonment and steer away from ideas or acts that can keep us divided.
By the way you have every right to disagree with Dr. Berekets ideas(that is what democracy is all about) but you should think very wisely before you jump into name calling. I call ISAYAS a murderer and thief because I have facts.
Here is piece of our constitution.

Article 15 – Right to Life and Liberty
      1. No person shall be deprived of life without due process of law.
      2. No person shall be deprived of liberty without due process of law.

Article 16 – Right to Human Dignity
      1. The dignity of all persons shall be inviolable.
      2. No person shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
      3. No person shall be held in slavery or servitude nor shall any person be required to perform forced labor not authorized by law.

Article 17 – Arrest, Detention and Fair Trial
      1. No person may be arrested or detained save pursuant to due
      process of law.
      2. No person shall be tried or convicted for any act or omission
which did not constitute a criminal offence at the time when it
      was committed.
      3. Every person arrested or detained shall be informed of the
grounds for his arrest or detention and of the rights he has in
connection with his arrest or detention in a language he
      understands.
      4. Every person who is held in detention shall be brought before
a court of law within forty-eight (48) hours of his arrest, and
if this is not reasonably possible, as soon as possible thereafter, and no such person shall be held in custody beyond
such period without the authority of the court.
      5. Every person shall have the right to petition a court of law for
a Writ of Habeas Corpus. Where the arresting officer fails to bring the person arrested before the court and provide the reason for his arrest, the court shall accept the petition and
order the release of the prisoner.
      6. Every person charged with an offence shall be entitled to a fair, speedy and public hearing by a court of law; provided,
however, that such a court may exclude the press and the public from all or any part of the trial for reasons of morals or national security, as may be necessary in a just and
      democratic society.
      7. A person charged with an offence shall be presumed to be innocent, and shall not be punished, unless he is found guilty by a court of law.
      8. Where an accused is convicted, he shall have the right to appeal. No person shall be liable to be tried again for any criminal offence on which judgement has been rendered.

    Dear Mr.Mike,

Your message to the audience is blured. Please donot dwell on the past. Yesterday and today are not the same.Everything is in motion and you need to move on.

As to the Constitution, you should know that it is the supreme law of the land(Eritrea) and a lot of time and expertise were put in it to become time immemorial regal document for democracy, justice and rule of law. It was ratified by the public and lives on the hearts of the people and the time of its implementation is around the corner.
One thing to remind you is that that profession Bereket is a top notch and honorable person. And should be proud of what he has contributed to his people. He is also a senior citizen who saw 4 regimes in his life.He has a wealth of experience. Probably you might be his grand son in terms of age. Dr.Bereket never said that the dictator stopped him from including the essential elements in the constitution, though he was trying through his loyalists to avoid some clauses. Now that the dictator revealed what he wanted to do, it is high time to respond against his wildest dream.

  • WediHagher January 3, 2015

Dr. Bereket is one of the few who voiced concern and regretted that mistakes were made during constitution making process. Many of the commission members either chose to remain silent or defended the regime. It would be a good idea if the good Dr. could suggest amendments to the unimplemented constitution taking into consideration the two decades of political crisis and instability in the country.
Transition to democracy is going to be very difficult, and the issues that can complicate a smooth transition can be easily handled by using constitution as a means to solve them.

  • Tesfit January 3, 2015

Dr. Berekhet is right. A dictator, no matter how much power he may have, can not simply make a constitution disappear into thin air. He will end up killed or jailed. Even that he can’t stop.

I think the idea that flows from miki is a belies to persident isaias. The commition for constitution for drafting this constitutional law takes 3 year.there was maney meeting in different cities and country sides. They take opinions from the people. doctor bereket and the other members of the commition are also will educated and more experience with different laws.
But if we saying doctor berket draft the constitution is not good and isaias constitution is also not good. I think this is a belies to isaias. We fighting each another and the dictator live for every.
    Good luck for eritrea!!!

The point is and was simple. Rule by the law, constituation garantee the law is above anything.
U can argue about details the constitution here and there but the main problem we face now is not its details but the rule by isyas instead of it.
We dont need new constituation becuse we already hv one that is ‘ratified’ so Can we revise and implenment that please as soon as tommorow.. mr psycho shaebia leader wedi afewrki?

P.s. dr bereket is genrally well respected n he is alright kind of guy so go easy on him its not his fault.

  • Yosief January 4, 2015

May I just join Wedi Hager and quickly in what they have said about Dr Bereket. Moreover I just want to say, whatever work or activities one does, there are always mistakes. Everybody should have the chance to criticize constructively even if the content of the criticism is wrong but all the same this should not prevent us from admiring what Dr Bereket has achieved so far. I think we should be happy that we have him. This chap is an Eritrean asset. I am sure there are also other Eritreans who could contribute to our beloved and betrayed country.

Let us work together and let us appreciate each other’s work; there is much to be said but much more to be done. We have a lot in common and let us create a good spirit among us! So that we can go forward.

God bless kibirti hagerna and hopefully sematatna wil rest one day, once and for all.
